13.06.2024 Item no. 17.

Court No.28.

AB (Rejected) CRM (DB) 1368 of 2024 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure in connection with Malipanchghora P. S. Case No.155 of 2023 dated 17.7.23 under Sections 406/420 /468/471/409 of the Indian Penal Code And In the matter of : Vikash Mundhra ......Petitioner.

Mr. M. Chatterjee ......for the Petitioner.

Mr. Antarikhya Basu, Ms. Sonali Bhar ......for the State.

Mr. Joydeep Biswas, Mr. Kaushik Ghosh, Mr. Rahul Banik ....for the Defacto complainant.

Report filed by the State in terms of the earlier order dated May 2, 2024, be kept with the records.

From the report, we find prima facie that the petitioner has filed unnecessary applications which have caused delay in consideration of the charges.

Learned Advocate for the defacto complainant strongly opposes the prayer for bail.

Be that as it may, we have considered the material on record. Prima facie, there appears to be incriminating evidence against the petitioner, who is charged with offences under various Sections of IPC including Sections 406, 409 and 420. The amount involved, we are told, is in the region of Rs.3 Crores. Signed By :

APURBA BANDYOPADHYAY High Court of Calcutta 14 th of June 2024 11:20:54 AM

Given the prima facie incriminating material against the present petitioner, we are not inclined to allow the prayer of the petitioner, at this stage.

The prayer for bail is, accordingly, rejected. CRM (DB) 1368 of 2024 is dismissed.

Let the issue of framing of charge be taken up on July 4, 2024, when the next date has been fixed by the learned Trial Court. Generally, the learned Trial Court is requested to expedite the trial and bring the same to its logical conclusion as soon as possible.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Arijit Banerjee, J.) (Apurba Sinha Ray, J.)
