22-05-2025 AKG Ct. 15 The petitioner seeks restoration of his domestic connection. Calcutta Electricity Supply Corporation (CESC) submits that on the allegation of theft of electricity, an inspection was conducted and following that a provisional order of assessment was made on May 4, 2025, for Rs. 3,81,904/- to be paid by the petitioner. The petitioner was asked to appear before the assessing officer for finalising the provisional order of assessment. Despite notice, the petitioner, however, did not appear before the assessing officer, instead he opted to file this writ petition before this Court.
It appears that the assessing officer has fixed today for hearing to pass the final order of assessment. The petitioner, however, has expressed his willingness to deposit the provisionally assessed amount, but a prayer has been made for granting suitable instalments
In that view of the matter, I dispose of this writ petition giving a direction upon the petitioner to deposit 50% of Rs. 3,81,904/- along with the incidental charges for reconnection. Upon such deposit, the line of the petitioner should be restored immediately.
The balance amount shall be paid in ten equal instalments along with the current bills. First of such instalments shall be deposited within 1st week of July, 2025.
The petitioner shall deposit the remaining instalments within the 1st week of each succeeding months.
It is made clear that if there is any default by the petitioner in making payment in terms of this order, CESC will be at liberty to disconnect the electricity connection of the petitioner.
Accordingly, WPA 10981 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
