1. Affidavit of service filed in Court today is retained with the record.

2. Complaining establishment and operation of a rubber factory in a residential area which according to the petitioner is causing environmental pollution and health hazard, a complaint was lodged with the District Magistrate on 21st December 2024 and 30th January 2026. The latter complaint was also forwarded to the West Bengal Pollution Control Board.

3. According to the petitioner, the factory is running at Uluberia on the basis of permanent

certificate of enlistment issued under the provisions of West Bengal Municipal Act, 1993.

4. The State, Municipality and the West Bengal Pollution Control Board are represented in Court.

5. Learned advocate appearing for the West Bengal Pollution Control Board submits that the Board has already taken cognizance of the complaint and steps are under way to make an enquiry on the basis of inspection to be conducted.

6. Learned advocate for the Municipality submits that the certificate of enlistment was issued on the basis of online application and no enquiry was conducted.

Having heard the learned advocates appearing for the respective parties and since the respondent no. 3 has stated that steps are being taken to consider the grievance of the petitioner by making an enquiry in the matter, let the instant writ petition be disposed of by directing the respondent nos. 3 and 4 to take a decision in this matter on expeditious basis preferably within 12 weeks from the date of communication of this order.

8. It is expected that a decision in this regard must be taken by the respondent no. 3 which shall be

communicated to the petitioner by passing a reasoned order.

9. With the above observation and direction, the writ petition is disposed of.
