Petitioner was aggrieved because the police authorities were not acting pursuant to the complaint being lodged with Techno City Police Station. Mr. Sengupta learned senior government advocate appearing on behalf of the state has submitted a report. Report reflects that Techno City Police Station Case No. 58/24 dated 17.04.2024 has been registered for investigation and statement of the victim has been recorded both under section 161 and 164 of the Code of Criminal Procedure.
The preliminary grievance so far as nonregistration of FIR is concerned, has been subserved. Petitioner complains that as she stays alone, there is a threat perception as the accused persons are influential and they are hand in gloves with each
other to cause harassment and/or other bodily injury as well as injury to the property of the petitioner. In such circumstances, I grant liberty to the petitioner as the present case is also under the provision of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 to take out appropriate application under section 15 A of the said Act before the jurisdictional special court which is in seisin of the matter. Jurisdictional special court would pass necessary orders in consonance with the provisions, so that adequate protection through the appropriate authorities may be rendered.
Accordingly WPA 11945 of 2024 is disposed of.
