Learned advocate appearing for the petitioner submits that the petitioner is in custody for 255 days and till date, although charges have been framed, but there has been no progress of the trial in spite of earlier directions passed by this Court on 22.01.2026 in CRM(NDPS) 1671 of 2025. Attention of the Court has been drawn till the order dated 07.05.2026 to emphasise that no witness was present. Learned senior advocate appearing for the NCB, on the other hand, opposes the prayer for bail and submits that evidence has commenced from June, 2026.

Records of the case reflect that there were earlier administrative issues for which the Trial Court was not available, consequently the trial of the case could not proceed.

I have also taken into account the report which reflects that another criminal case being Raghunathganj P.S. Case

No. 128 of 2025 is also against the present petitioner. Having considered the criminal antecedent of the present petitioner and the fact that efforts are exerted by the NCB authorities, at this stage, I am not inclined to release the petitioner on bail in view of the huge quantity of Heroin (3.209 Kgs.) being involved. As such, the prayer for bail of the petitioner is rejected.

The petitioner will renew his prayer for bail at the appropriate stage.

Report submitted on behalf of the NCB be kept with the record.

The application for bail, being CRM (NDPS) 1094 of 2026, is, thus, dismissed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
