1. Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case. The principal accused being one Biswajit Barman is not before this Court. Prior to this case, an FIR was registered from the side of the petitioners alleging commission of offences under the POCSO Act against the de-facto complainant and others. The present case is only a counter-blast.

2. Learned counsel appearing on behalf of the de-facto complainant strongly opposes the prayer for anticipatory bail. In 2025, a case was registered against the petitioner no. 3 and others.

3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the statements of witnesses and the injury report, which shows a head

injury requiring one stitch for repair. However, it does not appear to be a grievous injury.

4. Considering the above, the other materials available in the case diary, the fact that the principal accused is not before this Court and the fact that the petitioners are female members of the household, I do not think that custodial interrogation of the petitioners is required in this case and I am inclined to grant anticipatory bail to the petitioners.

5. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate the witnesses.

6. Accordingly, the application for anticipatory bail is allowed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
