Divn.), Malda in P.S. 459 of 2012, there has been breach of the said order at the behest of the private respondents.

Information, to that effect, was furnished with the police authorities, but the police authorities did not act on such information.

Learned advocate for the private respondents, on the other hand, submits

that some of the defendants have not been made parties to the present writ petition.

State has submitted a report which reflects that a proceeding under Section 126 of the BNSS has already been drawn up.

Having regard to the limited scope of the police authorities to act under such circumstances where learned Civil Court is already in seisin of the issues, I am of the view that the police authorities would continue their surveillance as also ensure that no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 11082 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copy of the report be handed

over to both the parties.
