Learned advocate for the State is present and submits a report. According to the State, there is a civil suit pending being T.S. No. 5 of 2015.

Learned advocate for the petitioner submits that he is not a party to the suit proceedings and the order is not binding upon him.

Having considered the submissions

advanced by the petitioner as also the State, I direct that, in case, there is a sanction plan and the status quo order passed in T.S. 5 of 2015 which is not in respect of the petitioner, then, in that case, the police authorities would ensure that if the petitioner proceeds with the construction, no hindrance be created by any of the parties.

Needless to state that the police authorities would first ensure regarding the civil court's order and the issue relating to status quo - whether the same binds the petitioner or not, thereafter, render their appropriate assistance to the petitioner.

With the aforesaid observations, WPA 11191 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
