...for the appellant There is a delay of 51 days in preferring the appeal. Moreover, with regard to valuation, the instant appeal is not maintainable before this Court in view of Section 21(1)(a) of the Bengal Agra and Assam Civil Court, (West Bengal Amendment Act, 2000).

In view thereof, the appeal stands dismissed for want of jurisdiction.

In view of the aforesaid order, the connected applications being CAN 1 of 2022 and CAN 2 of 2022 are also dismissed. The certified copy of the judgment and decree shall be returned to the learned Advocate-on-Record for the appellant upon retaining photocopy of the said judgment in order to enable the appellant to take appropriate steps in accordance with law.
