It is submitted on behalf of the petitioners that a portion of land owned by the petitioners was utilised for construction of Chakdah-Bangaon highway by the State respondents without any acquisition proceeding. As a consequence, no compensation was granted to the petitioners. The petitioners intend to submit a representation before the concerned authority in this regard and pray for a direction upon the State authorities to consider the same at the earliest.

Leaned counsel for the State respondents deny the contention of the petitioners.

Having considered the submissions made on behalf of the parties and material on record, this Court is of the view that the petitioners may submit a representation ventilating their grievance before the concerned authority which may be disposed of by the authority.

Accordingly, the petitioners are at liberty to submit a representation to that effect before the 3rd respondent

within a week from date. Such representation shall be considered and disposed of by the 3rd respondent within a period of three months from the date of such representation after giving reasonable opportunity of hearing to all the interested parties including the petitioners, in accordance with law.

WPA 11768 of 2021 is disposed of. However, there shall be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
