This application has been filed for recalling of the order dated 17.11.2021 and seeking restoration of the application for bail.

Having considered the averments made in the application being CRAN 1 of 2022, order dated 17.11.2021 is recalled. The application for bail is restored to its original file and number. CRAN 1 of 2022 is disposed of.

Petitioner is in custody for over 1000 days. He prays for bail. Learned Advocate for the State opposes the prayer for bail. He submits petitioner had absconded for more than three years.

We have considered the materials on record. Statements of witnesses implicate the petitioner in the murder. He had absconded for more than three years. Trial is in progress. Under such circumstances, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected. Trial court is requested to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
