In Re : An application under Section 482 of the Code of Criminal Procedure.

The revisional application was preferred challenging the proceedings in Complaint Case No. 16067 of 2011 pending before the learned 10th Metropolitan Magistrate, Kolkata under Sections 420/406/467/468/471 of the Indian Penal Code. The record reflects that the matter appeared on 06.07.12 and 07.09.2012 when none appeared to press the revisional application for admission.

Having regard to the fact that the revisional application has been pending before this court for about 9 years and the issues raised before this court are question of facts, I am of the view that the same cannot be adjudicated within the parameters of Section 482 of the Code. As such, the present revisional application being CRR 1626 of 2012 is dismissed.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
