Respondent nos.5-8 Re The petitioner claims that he and his mother is in possession of the land since 1994. However, a part of the land was sold to the private respondents. The private respondents approached the civil court by way of filing TS 524 of 2024.

It is claimed by the private respondents that, subsequently, there is an order of ad interim injunction and under Section 151 of the CPC, the learned Civil Judge has also passed directions upon the Inspector-in-charge of Basanti Police Station.

The petitioner's main grievance is that the trees and the other assets of the land are being taken away by the private respondents.

State has submitted a report which reflects that proceedings under Section 126/135(3) of the BNSS being drawn up.

Since the learned civil court is in seisin of the issues and the nature of the conflict is absolutely a private dispute, interference by the police authorities are unwarranted except to the extent that no breach of the peace and/or tranquility taking place as also no untoward incident resulting because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations, WPA 11237 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
