CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1638 of 2012 In the matter of : Sanat Kumar Chaudhuri. .....petitioner. In Re : An application under Section 482 of the Code of Criminal Procedure.

As the subject matter of this revisional application relates to an order of conviction and sentence, I am reluctant to interfere with the merits of this revisional application at this stage.

Having regard to the fact that the revisional application is pending and relate to the provisions of Section 138 of the N. I. Act, the interest of the complainant cannot be ignored at this stage.

Accordingly, the revisional application being CRR 1638 of 2012 is dismissed for default.

Learned Magistrate is directed to proceed with the provisions relating to execution of sentence and conviction. Department is directed to send back the L.C.Rs. forthwith to the court of the learned Metropolitan Magistrate, 15th Court, Calcutta.

If there are any deposit made, the same may be handed over to the complainant after the identification of the complainant is verified.

The learned Metropolitan Magistrate, 15th Court, Calcutta is directed to act in terms of the copy of this order duly downloaded from the official website of this court. Department is directed to communicate this order to the learned Metropolitan Magistrate, 15th Court, Calcutta with immediate effect.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
