1. The affidavit of service filed today is taken on record.
2. The petitioner is the widowed daughter of an employee, who expired sometime in 1973. The petitioner's mother, the wife of the deceased employee, received family pension till her death in December 2025. She had been receiving pension since 1973, from the date of death of the employee.
3. In terms of the Memorandum No. 732-F(Pen) dated November 12, the widowed/unmarried daughters are now entitled to the family pension on submission of certain documents. These documents have been specified in Clause 1 of the afore-stated notification.
4. One of the requirements is the Death Certificate of the deceased father or mother. If the Death Certificate of any one of the parents is provided, along with other documents as required, she would be entitled to be
considered for grant of family pension.
5. The petitioner had also made a representation on March 16, 2026, which is pending consideration.
6. Ms. Ghosal, learned Advocate appearing for the respondents, submits that the respondent no. 3 will consider the representation of the petitioner strictly in accordance with the Memo dated November 12, 2008 and will act on the basis of all documents specified therein and the Death Certificate of any one of the parents of the petitioner.
7. The entire exercise will be concluded by August 31, 2026 upon giving a hearing to the petitioner with adequate prior notice by the afore-stated timeline.
8. With the afore-stated directions, the writ petition is disposed of.
9. There shall, however, be no order as to costs.
