Mujibar Rahaman Mr. Rajaram Banerjee ... for the State Mr. Arindam Chattopadhyay ... for the DPSC, Nadia Mr. Ratul Biswas ... for the Board Heard the parties including the West Bengal Board of Primary Education and the District Primary School Council who are not inclined to take any step on their own in this regard, which is non-joining of the petitioner within the time frame granted to him by the appointment letter dated 17.02.2021.

The petitioner was directed to join within 15 days from the date of issue of the appointment letter which the petitioner failed. Thereafter the petitioner made one prayer for extension of joining time, which is at Annexure P-6, dated 22nd June, 2021.

I direct the Chairman, District Primary School Council to consider this representation after giving an opportunity of hearing to the petitioner within a period of four weeks from date.

Learned advocate for the District Primary School Council has submitted that they have already sent a report to the Board as to non-joining of some candidates who were issued appointment letters. This shows that there are some vacancies in the said district for the post of primary school teacher.

Keeping this aspect in mind, I think that the representation of the petitioner is required to be considered with sympathy and a reasoned order is required to be passed by the Chairman of the said District Primary School Council which is to be communicated by two weeks after the expiry of the four weeks as aforesaid.

With this direction this writ application is disposed of.
