The revisional application was preferred in respect of judgment and order passed in Criminal Appeal No.68 of 2011 wherein the learned appellate court was pleased to affirm the order of the learned Judicial Magistrate at Baruipur in B.G.R. No.4158 of 2003.

Having regard to the fact that the revisional application is not pursued before this Court, without entering into the merits of the case I dismiss the revisional application being CRR 1646 of 2012 for default.

Learned Judicial Magistrate is directed to proceed with the execution of the sentence.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

Department is directed to send back the lower court records forthwith to the jurisdictional court for necessary action. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
