Learned advocate for the petitioner submits that considering the period of detention of the petitioner and considering the fact that police submitted charge sheet, bail may be granted. He submits that the petitioner is on the same footing as that of a coaccused who was granted bail by the order dated December 1, 2020.

Learned advocate for the State draws attention of this Court to the contents of the case diary.

Considering the period of detention of the petitioner and considering the fact that police submitted charge sheet, we are inclined to grant bail to the petitioner.

Accordingly, the petitioner be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned CJM, Malda on condition that the petitioner shall appear before the trial court on every date of hearing until further orders and shall

not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. The application being CRM 4878 of 2021 is disposed of. (Ananda Kumar Mukherjee, J.) (Debangsu Basak, J.)
