Affidavit of compliance filed on behalf of the alleged contemnor is taken on record.

After perusing the affidavit of compliance, it appears that the petitioner and the private respondent in the writ petition has been adjudged on the basis of the marks obtained by them out of the total marks of 800.

The petitioner says that the procedure is faulty and as such, there is no compliance of the order under contempt.

After perusing the order under contempt and the procedure adopted, I find that there has been substantial compliance of the order. The petitioner's grievance that the adjudication should have been done

on the basis of total marks taken to be 800 cannot be adjudicated in contempt jurisdiction.

The contempt application is disposed by recording substantive compliance of the order.

In the event the petitioner has any grievance as to the procedure applied which requires passing a fresh order, petitioner shall be free to file fresh writ petition, subject to its maintainability in law irrespective of the contempt application having been disposed of. (Arindam Mukherjee, J.)
