Heard learned counsels for the parties.

The petitioner is in custody for more than one year and prays for bail.

Learned counsel for the petitioner submits that the case is based on circumstantial evidence and the petitioner stands on the same footing as the co accused who has been granted bail earlier.

Learned counsel for the State opposes the prayer. I have considered the material on record. The co accused who is on bail is a lady and the petitioner cannot claim to be similarly circumstanced with her. The offending weapon and portion of the mobile phone of the deceased were recovered from the petitioner's house at the instance of the petitioner. It is a fact that charges are yet to be considered.

Considering the material on record prima facie connecting the petitioner to the alleged offence, the prayer for bail is rejected at this stage.

The learned trial Court is directed to consider framing of charges or otherwise against the petitioner and other accused on the next date fixed for the same before him and take the trial to its logical conclusion as expeditiously as possible, without granting any unnecessary adjournment to either of the parties, in accordance with law. The application for bail is thus disposed of. Case diary be returned.
