The petitioners' claim that the petitioners residential house has been demolished by the concerned Gram Panchayat authority on raising a plea that the same was in dilapidated condition. Petitioner submits that such action of the Panchayat authority has rendered the petitioner homeless. He has no place to stay. He submits that this fact was brought to the notice of the concerned District Magistrate, Bankura, Sub Divisional Officer, Bishnupur, BDO, Bishnupur and concerned Pradhan by submitting a representation dated 7th May, 2025. However, such representation did not elicit any favourable response. This inaction has prompted the petitioner to prefer this writ petition.
Mr. Dutta, learned advocate representing the State, submits that, if the issue is relegated to the concerned Block Development Officer (BDO), the state will not stand in the way.
Taking note of such submission made on behalf of State and upon perusal of the Record of Rights, the writ petition is disposed of by directing concerned BDO to take decision on the petitioners' representation dated 7th May, 2025 in accordance with law after affording an opportunity of hearing to the petitioner and other interested parties within a period of eight weeks from the date of receipt of a copy of this order. In taking such decision, the BDO may call for the relevant records from the Panchayat Authority, if requires, to address the issue.
It is clarified that I have not gone into the merit of the claim raised by the petitioner in this writ petition.
All points are kept open to be decided by the concerned BDO.
There shall, however, be no order as to costs.
