A direction to secure expeditious disposal of an interlocutory application filed on January 15, 2015 under Section 151 of the Code of Civil Procedure praying for reconstruction of the damaged portion of the boundary wall, is the ultimate relief sought for in this case.

No other point is raised requiring address by this Court.

Mr. Sagnik Chatterjee, learned advocate appearing for the petitioner upon adverting to order dated 11th March, 2019 passed in C.O. 79 of 2019, submits that as per direction of this Court, out of three interlocutory applications, two have already been disposed of, but the third application referred hereinabove has not yet been disposed of, resulting in serious prejudice to the petitioner.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite parties.

Service of notice of this application upon

opposite parties stands dispensed with.

Accordingly, learned Civil Judge (Senior Division), 1st Court at Alipore in Title Suit No. 69 of 2015 is requested to ensure expeditious disposal of pending interlocutory application dated 15th January 2015, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable, preferably within a period of twelve weeks from the date of communication of this order. Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

This would not however prevent the Court below to ensure expeditious disposal of the suit after adhering to the due process of law.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
