Mr. Gouranga Kumar Das ... For the Petitioner Since the petitioner seeks expeditious disposal of M Execution 300 of 2020 including the application filed therein before the learned trial Court, the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the matter.

The execution case arose out of an order passed by the learned Judicial Magistrate, 3rd Court, Alipore on 5th September, 2017 and is still pending. The petitioner filed an application before the learned executing Court seeking necessary order for deduction of the due amount from the salary of the opposite party.

The said application is pending.

In view of the above, learned Judicial Magistrate, 3rd Court, Alipore is directed to dispose of the application filed by the petitioner on 1st December, 2022 within one month from the next date fixed before him. Learned Court shall also dispose of the execution case as expeditiously as possible without granting any unnecessary adjournments to either of the parties, in accordance with law.

C.R.R. 1786 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
