IN THE HIGH COURT AT CALCUTTA

Constitutional Writ Jurisdiction Appellate Side Ct.551 16.06.25 Item No.12 Sws.M WPA 11153 of 2025 Goutam Nandi vs.

State of West Bengal & Ors.

Mr. Mahadeb Sarkar Mr. Debasish Das ....for the petitioner Mr. Amal Kumar Sen, Ld. AGP Ms. Ashima Das (Sil) ...for the State Affidavit of serviced filed be kept on record. The petitioner complains of inaction on the part of the respondent No. 2 in taking a decision on the petitioner's application for extension/modification of route in respect of which the petitioner had been granted Permanent Stage Carriage Permit (Maxi Cab).

The petitioner submits that by an order dated January 24, 2024 passed in WPA No. 197 of 2024, this Court had directed the respondent No. 2 to consider and dispose of the petitioner's application within four weeks from the date of communication of the order upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. It is submitted that in terms of the said order, a hearing was taken on July 3, 2024 but till date no decision has been communicated to the petitioner. The petitioner complains that the respondent

authority has been sitting tight on the petitioner's application.

In view of the aforesaid this writ petition is disposed of by directing the Regional Transport Authority, i.e. the respondent No. 2 to take a decision on the petitioner's application for extension/modification of the route in respect whereof the petitioner has been granted Permanent Stage Carriage Permit (Maxi Cab), strictly in accordance with the directions passed by this Court on January 24, 2024 in WPA 197 of 2024 within a period of two weeks from the date of communication of this order.

In case the petitioner No. 2 has already taken such decision in terms of this Court's aforesaid order dated January 24, 2024, the said respondent No. 2 shall communicate such order to the petitioner within a week from the date of communication of this order.

With the above observations, WPA 11153 of 2025 stands disposed of.

There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai , J.)
