The petitioner applied for obtaining certified copy of certain documents in respect of a case being No.C-392/2024. The application was made before the 3rd Judicial Magistrate, Diamond Harbour on November 21, 2024. Allegation is that the same has not been supplied till date. 2.

Learned counsel for the State has obtained instruction from the Judicial Magistrate, 3rd Court, I.C. Diamond Harbour dated August 26, 2025 wherefrom it appears that the police report sought for by the petitioner was kept and registered as Misc. Petition No.633/2024 under the custody of the learned ACJM Court. The concerned police report is not tagged with the case No.C-392/2024 which is pending before the learned Judicial Magistrate, 3rd Court.

The Judicial Magistrate has mentioned that since the Court does not have a copy of the same, certified copy of the required document cannot be provided.

In view of the report filed by the learned Judicial

Magistrate, the instant writ petition is disposed of by granting leave to the petitioner to approach the learned ACJM by mentioning the Misc. Petition No. 633/2024 for obtaining the certified copy of the same.

In the event such application is made, the same shall be supplied to the petitioner at the earliest, subject to compliance of all necessary formalities. 6.

The writ petition stands disposed of.

Affidavit of service filed in Court be taken on record.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
