15.06.2022 sdas rejected C.R.M. (NDPS) 628 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Raninagar Police Station Case No. 599 of 2018 dated 12.11.2018 under Sections 21(c )/29 of the NDPS Act.

And In Re : Sakib Mirdha ..... petitioner Mr. Parvej Anam ... for the petitioner Mr. N. Ahmed, learned APP ... for the State Having considered the materials on record disclosing prima facie involvement of the petitioner in the alleged possession of narcotic substance above commercial quantity i.e. 60 bottles of phensedyl syrup containing codeine phosphate and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected. Trial court is directed to expedite the trial and conclude the same without granting any unnecessary adjournment to either of the parties.
