The grievance of the writ petitioner is that the Chief Medical Officer of Health, Nadia, being the respondent no.4, has engaged the private respondent no.8 to provide Security Services in some Hospitals in the Nadia District.

It is submitted that the private respondent no.8 does not have licence under the West Bengal Private Security Agencies (Regulation) Act, 2005.

It is further submitted that certain chargesheets have been filed and are pending against the respondent no.8.

Admittedly, the said charge-sheets have not been tested in trial. The question of holding the

petitioner ineligible, therefore, does not and cannot arise.

It is, however, made clear that the respondent no.4 shall be entitled to review the work order granted to the writ petitioner, in the event of any conviction or any proof thereof.

At page 33 of the writ petition a licence dated 20th November, 2014 has been annexed. The petitioner even otherwise are supplying sweeping and cleaning staff to the hospitals under the CMOH. The allegations made by the writ petitioner are, therefore, baseless. The writ petition is dismissed.
