The revisional application is not maintainable. Misc. Case No.22 of 2015, is an application under Order 9 Rule 13 of the Code of Civil Procedure, which was dismissed for default by the learned Additional District Judge, 1st Court at Alipore. The misc. case was filed in connection with Matrimonial Suit No.16 of 2014.

Accordingly, the revisional application is dismissed. Liberty is granted to the petitioner to proceed in accordance with law. Liberty is also granted to take back the certified copy, upon furnishing a photocopy thereof. All the parties are directed to act on the basis of the server copy of this order.
