1. Petitioner is in custody for more than a year. He submits he is a former constable and has been falsely implicated. There is 40 days' delay in lodging FIR. Prosecution case that the de facto complainant and another was carrying cash over Rs. 1 crore to make RTGS transfer is patently absurd. There is no progress in the matter. He renews his bail prayer.
2. Learned lawyer for the State opposes the bail prayer.
3. We have considered the materials on record. De facto complainant Gautam Jha was carrying cash. He was accosted by miscreants. He has identified the petitioner as one of the miscreants who stole cash. Portion of the stolen cash was recovered from the petitioner. Petitioner is a former police officer.
4. In view of the aforesaid circumstance and as delay is due to abscondence of co-accused, we are not inclined to grant bail to the petitioner.
