And In Re :

Anarul Hoque ... Petitioner.

Mr. Anupam Das Mr. Soupal Chatterjee ... for the petitioner.

Ms. Baisali Basu Mr. Nirupam Dhali ... for the State.

Report submitted by the State is taken on record. Heard learned counsels for the parties.

The petitioner is in custody for about 9 months. Learned counsel for the petitioner submits that there is no independent witness to the seizure. Currency notes and iron made improvised fire arm were seized from the possession of the petitioner. The petitioner prays for bail. Learned counsel for the State opposes the prayer and submits that improvised fire arm and fake currency notes to the tune of Rs.20,000/- were seized from the petitioner. Since the seizure was made in the middle of the night no independent witness was found. The petitioner has criminal antecedents.

In view of the above, prayer for bail is rejected at this stage.

The application for bail is thus disposed of.
