1. Heard the learned advocates representing the parties.

2. The admitted position based on submissions advanced by the parties is that the application has become redundant and infructuous in view of the events subsequent to filing of the application. It is admitted that after handing over the matter to the CBI, the investigation has advanced much further. Therefore, without going into the issue on merits, in view of the subsequent development noted above, we dispose of the application.

3. The learned advocate for the applicant submits that certain issues were raised in the appeal as to whether for the reasons specified in the order under appeal, the matter could have been transferred to the CBI or not.

4. Since the matter has become infructuous due to events subsequent to filing of the appeal, and we are not going into the merits of the case, we leave the issues raised in the appeal to be agitated in appropriate proceedings, if and when the same arises, in accordance with law.

5. The application and the appeal stand disposed of accordingly.
