The present writ petition was preferred before this Court for proper investigating of a case being Khardah P.S.

Case No.

278/2017 dated 08.04.2017. Presently further investigation of the case is in progress. A report has been submitted pursuant to the direction passed by this Court on 13.01.2025 wherein the investigating officer of the case applied for reseizure of gold ornaments which are lying at Gaya Treasury, Bihar. The said application was considered by the learned District Additional & Sessions Judge-XVII, Gaya. However, the concerned court refused to hand over the gold ornaments for reseizure to the investigating officer of the case as in respect of the case at Gaya, the

said ornaments have not been exhibited and also on security reasons.

Since appropriate steps have been taken by the investigating officer of the case, I direct that in case the petitioners are aggrieved by the order passed by the learned District Additional & Sessions Judge-XVII, Gaya, the petitioner/company would be at liberty to approach the jurisdictional higher forum.

So far as the investigation of the case is concerned, the same is being progressed by the present investigating officer.

The concerned investigating officer would submit progress report before the learned ACJM, Barrackpore once in a month and take the investigation of the case to its logical conclusion.

If the State is aggrieved by the order passed by the Trial Court at Gaya, the State would also be at liberty to approach the higher forum challenging the aforesaid order.

With the aforesaid observations, the writ petition being WPA 12105 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
