Learned advocate appearing for the petitioner submits that the private respondents are interfering with the peaceful possession of the petitioners, disturbing them as also threatening of dire consequences which has become unbearable for the petitioner to stay at the particular property. Learned advocate for the State submits that there is a long standing dispute between the petitioner and the private respondents over the property which has been referred. To that effect, petitioner has approached the Civil Court in T.S. No. 651/2018 which is pending before the learned Civil Judge (Senior Division), 2nd Court, Baruipur. Having considered that the Civil Court is in seisin of the issue, the apprehension of the

petitioner so far as encroachment of the property is concerned, petitioner would approach the jurisdictional Civil Court for appropriate remedies. However, the police authorities would only ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations WPA 11188 of 2025 is disposed of.
