The grievance of the petitioner in the present writ application is that the petitioner is the owner of the property-in-question but the private respondent nos. 5 and 6 i.e. the daughter-in-law and grandson have ousted the petitioner from her house and accordingly the petitioner has made complaint to the Sub-Divisional Officer, Kharagpur, District - Paschim Medinipur on April 5, 2024 but in spite of receipt of the complaint till date no action has been taken by the concerned authority. She prays for a direction upon the SubDivisional Officer i.e. the respondent no. 4 in the present writ application to consider the representation submitted by the petitioner dated April 5, 2024 and to pass a reasoned and speaking order by giving an opportunity of hearing to the petitioner.

2. Learned counsel appearing for the private respondent nos. 5 and 6 submits that in the complaint there is no averment that when the petitioner has been ousted from the house. He further submits that the private

respondent nos. 5 and 6 have never ousted the petitioner from the said house and still ready and willing to keep the petitioner along with them.

This Court without going into the merit of the matter, the writ petition is disposed of by directing the SubDivisional Officer, Kharagpur, District - Paschim Medinipur to consider the representation of the petitioner dated April 5, 2024 by giving an opportunity of hearing to all the concerned persons and after hearing all the parties to pass a reasoned and speaking order within a period of eight weeks from the date of receipt of this order.

4. Accordingly, WPA 12098 of 2024 is disposed of.

5. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
