Affidavit of service filed by the petitioner is taken on record.

The present writ petition has been filed so as to call upon the municipal authorities to take steps in relation to the unauthorized construction being carried out by the private respondent in Holding no. 37, D. N. Sarkar Lane, P.O.- Sarbamangala Para, P.S.- Burdwan, District- Purba Bardhaman- 713 102.

Today, the learned advocate for the petitioner would submit that since the parties are trying to resolve the disputes, the matter may be adjourned.

The private respondent, on the other hand, would submit that the private respondent is a tenant and has not carried out any illegal construction. 5.

Though the municipality is not represented, the State is represented.

Having heard the learned advocates appearing for the respective parties and though the learned advocate for the petitioner would submit that the parties are trying to resolve the disputes amicably, however, having regard to the fact that the case of illegal construction has been made out, the municipality must enquire into the matter and dispose of the same by passing a reasoned order in accordance with law. 7.

It is expected that the decision in the regard shall be taken by the municipality on an expeditious basis, preferably within a period of six weeks from the date of communication of this order.

With the above observation and direction the writ petition stands disposed of.

Since no affidavit in opposition is called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.
