The petitioner alleges that the Sub-Divisional Officer, Chanchal Sub-Division, Malda being the prescribed authority under Section 11(1)(d) of the West Bengal Panchayat Act, 1973, has not taken any steps despite the applications filed by the petitioner who is the Pradhan of Samsi Gram Panchayat, Samsi, Malda. Copies of such applications for removal of some of the members of the said Gram Panchayat, have been annexed to the writ petition.

Having considered the submissions of the rival parties, the writ petition is disposed of with a direction upon the prescribed authority to dispose of the complaints filed by the petitioner against some of the members of the Samsi Gram Panchayat expeditiously and in accordance with law.

It is expected that the prescribed authority shall exercise his jurisdiction vested upon him by law and not allow the applications to become an exercise in futility. The writ petition is, thus, disposed of. This court has not gone into the merits of the claim of the petitioner. There will be, however, no order as to costs. All parties are directed to act on the basis of the server copy of this order.
