This is an application for restoration.

Having heard the submissions made on behalf of the petitioner and in view of the grounds enumerated in the petition, CAN 1 of 2026 stands allowed. The order dated 4th February, 2026 stands recalled.

WPA 8697 of 2008 is restored to its original file and number. By consent of the parties the writ petition is taken up for hearing.

In Re :- WPA 8697 of 2008.

The writ petition has been pending since 2008. Pursuant to the directions of Court, an authorized representative of the petitioner is present in Court. It is fairly submitted on behalf of both the parties that there is an outstanding amount of Rs.2,45,990/-,

which is due and payable by the petitioner to the respondent-CESC Ltd.

It is also submitted on behalf of the CESC Ltd. that the meter is in a live condition and the petitioner is making timely payment of their electricity bills. In view of the above, WPA 8697 of 2008 stands disposed of by granting the petitioner 20 instalments commencing from 15th June, 2026 every month and to be paid in consecutive monthly instalments.

It is made clear that in default of any one instalment, CESC Ltd. is at liberty to disconnect the electricity connection of the premises of the petitioner. It is also made clear that the above amount of Rs.2,45,990/- will not carry any interest component. The above direction is in additional to the timely payment of the regular monthly bills raised by the CESC Ltd.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
