By the impugned notice, the bank as a secured creditor invoked the provisions of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and Rules framed thereunder to proceed against its secured assets. There are statutory alternative efficacious remedies available against the impugned notice. In such circumstances, I am not minded to interfere as a Writ Court.

Accordingly, WPA 11878 of 2021 is dismissed without any order as to costs.

Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
