None ...for the petitioners Mr. Swapan Banerjee Mr. Suman De ... for the State The present revisional application reflects that the petitioners are aggrieved by delay in the proceedings. The impugned order dated December 28, 2017 of the learned Additional Chief Judicial Magistrate, Serampore reveals that the learned court called for a report from the concerned police station regarding death certificate of Binod Singh and Usha Singh @ Devi.

I do not find any illegality in the learned ACJM's order for causing any interference. However, the petitioners may have grievance as the case was initiated in the year 2007 and because of absence of some of the accused persons before the court, the trial court could not proceed in its normal pace.

Having regard to the grievance of the petitioners, I direct that the learned court below would exhaust the process of law within a period of one month from the date of receipt of this order so far as the absconding accused are concerned, and thereafter segregate the trial of the case in respect of the accused persons who were appearing before the court regularly and intending to abide by the provisions of law.

The learned trial court, after segregating the case, would see that the trial of the case is continued in a regular manner so that the

accused persons who are before the court for a considerable of time are not unnecessarily harassed.

With the aforesaid observations, CRR No.1628 of 2018 stands disposed of.
