Petitioner is aggrieved by the fact that the 15.05.2025 Court No. 35 Item No.19 Rakib representation dated 23.03.2023 with the Inspector-inCharge, Sarenga Police Station has not been considered. So far as the accusations are made in the same information furnished to the police authorities, which reflects that the same relate to settlement of amount amongst the partners of the partnership firm. State has submitted a report. Report reflects that in view of the nature of the dispute, police authorities of Sarenga Police Station drew up a proceeding under Section 107 of the Cr.P.C. at the relevant period of time. Be that as it may, in view of the passage of time which has passed, I am of the opinion that petitioner would be at liberty to approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would assess whether any offence has been made out and thereafter ascertain whether a case for

investigation is made out and then only pass necessary directions.

With the aforesaid observations WPA 11285 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
