1. Affidavit of service, as filed, be kept with the record.

2. The petitioner challenges the auction sale of his property, which was mortgaged towards the loan availed by him from India Infoline Finance Limited.

3. The petitioner submits that a substantial part of the outstanding amount has already been paid, though the said financial institution is still holding on to the possession of the property.

4. The only grievance of the petitioner is against an entity which, is a private body and thus, does not fall within the ambit of Article 12 of the Constitution of India. Hence the writ-petition is not maintainable.

5. WPA 11295 of 2023 is accordingly dismissed. No order as to costs.
