PP Ms. Shalini Bairagi ...for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner is only a friend of the principal accused and is in no way connected to the alleged offences. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statement of the victim recorded before the police as well as before the learned Magistrate and the statement of the other witnesses. As per the 13 year old minor victim, the principal accused and the present petitioner kidnapped her and took her to the house of the principal accused where she was forcibly given in marriage to the principal accused and was thereafter sexually violated.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner. Accordingly, the application for anticipatory bail is rejected.
Urgent photostat certified copy of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
