Md. Wasim Akram Md. S. Ali ............. For the Respondent no. 9. The grievance of the petitioner is directed against an illegal and unauthorized construction by the private respondent.

It is submitted on behalf of the petitioner that without any or authority of law permission, the private respondent has carried out unauthorized and unlawful construction in a plot adjacent to the plot of the petitioner. In support of the unlawful construction the petitioner has also relied on a Report of the concerned Gram Panchayat being the Behariya Gram Panchayat which has confirmed that unlawful and unauthorized construction has taken place by the private respondent.

The State respondent is represented and S.D.

submits that unlawful and unauthorized

construction has been carried out without any permission and thereafter subsequent to the filing of the writ petition the same has stopped.

It is also submitted on behalf of the State respondents that they are ready and willing to demolish the unauthorized construction.

In view of the above admitted facts the respondent no. 7 is directed to take necessary steps for demolition of the illegal, unlawful and unauthorized construction at the subject premises within a period of twelve weeks from the date of communication of this order in accordance with law. With the above directions, W.P.11289(W) of 2023 stands disposed of.
