Learned advocate appearing for the petitioner is anxious regarding the manner in which the proceedings are progressing before the learned Judge, Special Court (NDPS), 6th Court, Barasat. It has been submitted that the petitioner is in custody since 13.05.2020 and although charge has already been framed, out of eight witnesses, so cited by the prosecution, only one witness has been examined. In view of the submissions so advanced by the learned advocate for the petitioner, Ms. Sujata Das, learned advocate was directed to represent the State. Her appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner has also informed that next date has been fixed in the month of August 2022.

As the petitioner is in custody for more than 2 years and 7 witnesses are yet to be examined, I direct the learned trial court to fix schedule consisting of three dates and such

schedule must be fixed once in every two months so that the trial can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties and the learned public prosecutor, representing the State, would assure the court regarding the availability of the witnesses prior to the date being fixed.

With the aforesaid observations, the revisional application being CRR 1950 of 2022 is disposed of. All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
