Mr. Gurudas Mitra Mr. Utsav Dutta ....for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an employee of the West Bengal Police. He had a relationship with the victim. In fact, they registered their marriage. The social marriage was to be performed after the marriage of the petitioner's younger sister. In the meantime, the petitioner was transferred to North Bengal. The victim entered into a relationship with another person and was scolded by her father. This, prompted her to commit suicide.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the case diary including on the post mortem report, the statements of witnesses, especially the statement of a child present at page 82 of the case diary. The prime contention of the de facto complainant is that the petitioner was postponing the social marriage because he wanted the victim's family to provide money to him regarding construction of his house. On the day immediately before the date of suicide, the petitioner went to the

house of the victim and assaulted her. This was witnessed by a child, among others. There is no indication whatsoever in the case diary that the victim was involved in any other relationship. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
