Petitioner is a senior citizen who alleges of being tortured at the behest of his son and daughter-in-law and the petitioner apprehends that he may be thrown out of the house. To that effect, petitioner has complained to the Inspector-inCharge, Joynagar Police Station and also to the SubDivisional Officer, Baruipur. Learned advocate for the private respondents submits that the parents are staying with them and there is no dispute and difference with the parents and the present case has been

initiated at the behest of other relations for disrupting the family peace and tranquility.

State has submitted a report. Report reflects that Joynagar Police Station has already drawn up proceedings under section 126 of the BNSS. Petitioner has also informed to the SubDivisional Officer under the relevant provisions of Maintenance and Welfare of Parents and Senior Citizens Act.

However, petitioner is unaware regarding the results of the proceedings before the SDO.

Having regard to the same, I direct the SubDivisional Officer, Baruipur to send a notice to the petitioner in respect of the date fixed for consideration of the prayers preferably within a month from the date of communication of this order. Notice be also issued to the affected parties before any adverse order is passed.

The Inspector-in-Charge would keep a vigil through a lady police personnel who would ensure that no untoward incident results because of complaint of strained relationship between the petitioner and the private respondents who are the mother, son and the daughter-in-law.

With the aforesaid observations WPA 11246 of 2025 is disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner as well as the respondents.
