Affidavit-of-service filed by the petitioners be kept with the record.

Supplementary affidavit filed by the petitioner no.1 be also kept with the record. Petitioner no.1 alleges that her step son has been causing inconveniences and disturbances and to that effect has not spared her minor daughter. Several informations were furnished before the police authorities but no steps were taken. However petitioners informed that pursuant to the writ petition having been preferred before this Court, Daspur P.S. Case No.234 of 2025 dated 23.05.2025 has been registered for investigation under the relevant provisions of the BNS as well as the POCSO Act. Since the police authorities have registered the case, they are directed to act in accordance with

the relevant provisions within the time frame for which the report under Section 193 of BNSS are to be filed before the learned special court.

Police authorities would also ensure that since a case under the POCSO Act has been registered, the protection of the witnesses and complainant and/or their family members be provided so that at the behest of the accused persons named in the FIR, no further untoward incident results.

With the aforesaid observations, WPA 11038 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
