1. Affidavit of service filed on behalf of petitioner is taken on record.

2. Learned advocate representing petitioner submits that petitioner owns a piece of land and he should be allowed to enjoy peaceful possession of the said land in question.

However, it is alleged that respondent no. 6 has encroached part of said plot of land owned by the petitioner prompting the petitioner to approach this Court with this writ petition seeking direction upon the concerned police authorities to protect his right over the land in question.

3. State respondents are represented by Mr.

Mitra, learned advocate who has opposed this writ petition and it is submitted that issue involved in this writ petitioner is civil in nature.

4. Having considered the case made out in this writ petition and submissions made on behalf of respective parties it appears that petitioner is aggrieved by alleged encroachment of land

by the respondent no. 6. Police authority is not the appropriate authority to decide inter se right of the parities over the land in question. If petitioner's peaceful possession over the land is disturbed by the respondent no.

by encroachment then petitioner needs to approach civil court in pursuit of remedy.

5. Hence, writ petition is not entertained and same stands dismissed.
