While making submissions in support of the writ petition, Mr. Ekramul Bari, learned counsel for the petitioner refers to a decision of the Hon'ble Division Bench, In the matter of : Asok Kumar Malik -vs- The State of West Bengal & Ors. reported at (2013) 1 CHN 538. Upon reading of the said judgement of the Hon'ble Division Bench, it appears to this Court that an Office Order issued under Memo No.
1360-SE (Law)/SL/5s198/12 dated 27th August, 2012 would be of great relevance in adjudicating this writ petition. Mr. Bari submits on the strength of the said Memo dated August 27, 2012, the power of the jurisdictional Additional District Inspector of School is same with that of the jurisdictional District Inspector of School.
In view of the above, Mr. Manwar Ali, learned State Counsel appearing in the matter shall produce the said Government Memo No.
1360-SE (Law)/SL/5s198/12 dated 27th August, 2012 on the next day when the writ petition shall be taken up for further consideration.
The writ petition shall appear under the heading "For Orders" on January 11, 2024.
Learned State counsel shall serve a copy of today's order upon the respondent no.2 to expedite the process.
