The petitioners are the retired employees of the West Dinajpur Spinning Mills Ltd. They seek benefit of enhanced gratuity in terms of the Memorandum of the Additional Chief Secretary to the Government of West Bengal, Finance Department (Audit Branch), dated 14th September, 2023.

A representation seeking such benefit is alleged to be pending consideration before the Managing Director of the West Dinajpur Spinning Mills Ltd.

Prayer has been made to direct the Managing Director to take steps for granting benefit in terms of the aforesaid Memorandum.

Learned Advocate representing the West Dinajpur Spinning Mills Ltd. submits, upon instruction that, the application made by the petitioners seeking enhanced gratuity has already been forwarded to the competent authority for a decision in the matter.

Upon hearing submissions made on behalf of both the parties and on perusal of the materials on record as it appears that, the petitioners' prayer seeking enhanced benefit in terms of the Memorandum dated 14th September, 2023 is pending consideration, accordingly, the instant writ petition stands disposed of by directing the Managing Director of the West Dinajpur Spinning Mills Ltd. to follow up the matter with the Principal Secretary, Department of Micro, Small, Medium Enterprises and Textiles Department and also obtain necessary sanction from the Finance Department. 7.

A decision in the matter by the aforesaid respondents shall be taken at the earliest but positively within a period of twelve weeks from the date of communication of this order.

If the prayer of the petitioners is allowed, then necessary consequential steps for releasing payment in terms of the subject Memorandum shall be taken without any further delay.

Learned Advocate representing the petitioners is directed to forward a copy of the subject representation along

with the Memorandum to the aforesaid respondents at the time of communicating the order of the Court. 10.

Parties are to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

Urgent Photostat certified copy of this order, if applied for, be furnished after completion of all requisite formalities.
